1.- PURPOSE.

These general conditions of use (hereinafter GCUs) regulate access to and use of the Website under the domain WWW.ALE-HOP.ORG (hereinafter Website), owned by "CLAVE DENIA, S.A." (hereinafter ALE-HOP), which is made available to users (hereinafter User(s)).

Regarding any questions or inquiries related to the use and access of the Website or these GCUs, you can contact us using the contact information published in the Legal Notice.

2.- COMPLIANCE WITH THESE GENERAL CONDITIONS.

Use of the Website implies the User's full acceptance of the GCUs in effect every time the User accesses it. Therefore, if you do not agree with any of the conditions established here, you must refrain from using this Website.

Consequently, the User should read the GCUs carefully each time they intend to use the Website.

In any case, ALE-HOP reserves the right to modify the GCUs without prior notice and at any time. ALE-HOP also reserves the right to suspend, interrupt or cease operating the Website at any time.

"Use of the Website" is understood to mean all Users who access and navigate the Website regardless of whether they fill out the registration forms.

3.- CONDITIONS OF ACCESSING AND USING THE WEBSITE AND ITS CONTENTS.

Access to the Website and/or the Contents included therein does not imply any sort of guarantee regarding the Website's suitability and/or the Contents included therein for the Users' private or specific purposes.

ALE-HOP may establish limitations and/or additional conditions for the use of and/or access to the Website and/or the Contents, which must be observed by the Users under all circumstances.

3.1- Access and Use of the Website.

Except as otherwise provided, the use of the Website will be free of charge, notwithstanding the cost of connecting through the corresponding telecommunications network that the User may have agreed to.

The User acknowledges that they are at least eighteen years of age; they are also aware of and voluntarily and expressly accept that use of the Website is done under their sole and exclusive responsibility in all circumstances.

The User undertakes to comply with the GCUs, as well as to comply with the special notices or instructions contained on the Website and to always act in accordance with the law, good manners, and the requirements of good faith, giving their utmost attention to considering the nature and consideration of the service they enjoy. For this purpose, they will refrain from using the Website in any way that may impede, damage, or impair its normal functioning, the goods or rights of ALE-HOP, its suppliers, distributors, other Users, or any third party in general.

Specifically, without implying any restriction on the obligation assumed by the User in general in accordance with the previous paragraph, the User is obliged to the following by using the Website:

  1. Not to add, store, or share any information or material on or from the Website that is defamatory, libelous, obscene, threatening, xenophobic, or pornographic; related to terrorism; incites violence, discrimination based on race, sex, ideology, or religion; or that in any way threatens the form, public order, fundamental rights, public freedoms, honor, privacy, or the image of third parties; and in general the regulations in effect.
  2. Not to add, store, or share through the Website any computer program, data, virus, code, or any other electronic or physical instrument or device that is likely to cause damage to the Website, any of the services, or any of the equipment, systems, or networks belonging to ALE-HOP, to any Users, to ALE-HOP's Suppliers or Distributors, or to any third party in general, which is capable of causing any sort of disruption or impeding the normal functioning of the same.
  3. Not to add, store, or share through the Website any content that infringes the regulations regarding intellectual or industrial property or the rights of third parties, nor any content in general to which they do not, in accordance with the law, hold the right to make available to third parties.

3.2- Access and Use of the Contents.

The Website Contents are made available to the User with information from both our own and third-party sources.
ALE-HOP undertakes to ensure that the Contents are of the highest possible quality and are reasonably up-to-date, but it does not guarantee the usefulness, accuracy, completeness, relevance, and/or timeliness of the Contents.

4.- INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS.

These GCUs do not grant any intellectual or industrial property rights to the Website nor to any of its constituent elements. Any reproduction, transformation, distribution, public communication, process of making available, extraction, reuse, forwarding, or use of any nature of any of these by any means or procedure is expressly prohibited for the User, except in cases where it is legally permitted or authorized by the holder of the corresponding rights.

The User may view and obtain a temporary private copy of the Contents for their exclusive personal and private use on their computer systems (software and hardware), provided that it is not for the purpose of developing commercial or professional activities. 5.- EXCLUSION OF WARRANTIES AND LIABILITY.

5.1.- Exclusion of Warranties and Liability for the Website's Operation.

ALE-HOP does not ensure the availability and continuity of the Website's operation nor of the services or Content offered therein, nor that the existing content on their Website is up-to-date; they will not be held liable for damages of any nature that may arise from such circumstances.

ALE-HOP will carry out all work necessary to correct the errors, re-establish communication, and/or update the content in question, provided that there are no circumstances that make it difficult or impossible to do so, and as soon as they receive news of errors, disconnections, and/or lack of updating the contents.

Likewise, ALE-HOP does not guarantee either the technical reliability of its Website or access to its various pages; it is similarly exonerated from all liability for damages of any nature that may arise from this cause.

In addition, ALE-HOP is not responsible for possible errors or deficiencies in security that may occur due to the User's use of an outdated or insecure version of a browser, nor for damages, errors, or inaccuracies that may arise from the malfunction thereof.

In order to reduce the risk of viruses being added to the Website, it uses virus detection programs to monitor all the Contents added to the Website. However, ALE-HOP does not guarantee the absence of viruses or any other elements on the Website introduced by third parties unrelated to ALE-HOP that may cause alterations to users' hardware or software systems or in the electronic documents and files stored on their systems. Accordingly, ALE-HOP will not under any circumstances be held responsible for damages of any kind that may arise from the presence of viruses or other elements that may cause alterations to the User's hardware or software systems, electronic documents or files.

ALE-HOP adopts various protective measures to protect the Website, the data collected, and the Contents against third-party computer attacks. However, ALE-HOP does not guarantee that unauthorized third parties may gain access to the User's type of use or navigation of the Website or the conditions, characteristics, and circumstances in which this is carried out. Accordingly, ALE-HOP it will not under any circumstances be held responsible for damages that may arise from such unauthorized access.

ALE-HOP will not under any circumstances be held responsible for users' and/or third parties' use of the Website or the Contents, nor for the damages and losses that may arise from it.

5.2.- Exclusion of Warranties and Liability for the Contents. ALE-HOP does not edit the Contents of third parties published on the Website; consequently, it does not guarantee or take responsibility for the legality, reliability, usefulness, veracity, accuracy, completeness, or timeliness of those Contents, nor the Contents owned by ALE-HOP. ALE-HOP will not in any way be held responsible for any damages that may arise from: (i) the lack of legality, reliability, accuracy, completeness, and/or timeliness of the Content originating from third parties, and their own; (ii) the unsuitability for any purpose, or the defrauding of expectations generated by the Contents; (iii) decisions or actions taken or avoided by the user relying on the information or information or Content provided, including but not limited to loss of profits or business opportunities.

6.- HYPERLINKS.

Those who intend to set up hyperlinks between their website and the Website must observe and comply with the following conditions:

  1. Prior authorization will not be necessary when the Hyperlink only points to the home page of the Website, but you may not reproduce it in any form. Any other form of Hyperlink will require the express and unequivocal authorization of ALE-HOP in writing.
  2. The Web page on which the Hyperlink is established may only contain what is strictly necessary to identify the destination of the Hyperlink.
  3. The website on which the Hyperlink is established will not contain illegal information or content, content that goes against morality or generally accepted good customs and public order, nor will it contain content that violates any rights of third parties.
  4. ALE-HOP reserves the right to block Hyperlinks directed to the Website that do not have prior express authorization, even if they are in compliance with the provisions of this point of the General Conditions.

7.- ACTIONS IN CASE OF NON-COMPLIANCE.

ALE-HOP reserves the right to exercise as many actions as are available by law to hold a User accountable for the liabilities arising from the breach of any of the provisions of these General Conditions of the Website

8.- PARTIAL NULLITY.

The declaration of any of the clauses contained in these General Conditions as null, invalid, or ineffective will not affect the validity or effectiveness of the remaining clauses, which will remain binding between the parties.

9.- APPLICABLE LAW AND JURISDICTION.

These GCUs will be governed by the provisions of Spanish legislation.

For any dispute regarding the conditions of use and access to this Website contained in this document on the GCUs of the Website, the parties will submit to the Courts of Gandia, expressly waiving any other jurisdiction that may correspond to them unless determined otherwise by legal obligation.

10.- NOTIFICATIONS.

For the purposes of carrying out the appropriate notifications, ALE-HOP designates the address specified in the Legal Notice as the contact address.

The e-mail address provided by the User during the registration process on the Website will be the one used by ALE-HOP for the purpose of sending the User notifications.

The User is obliged to keep the information referenced in this clause for the purposes of notifications duly updated.

All notifications that ALE-HOP sends to the User will be considered validly made if they have been made using the information provided through the means indicated above. ALE-HOP is not responsible for any damages that may occur due to the User's breach of their obligation to keep their contact information up-to-date.
