General Conditions of Hiring

1.- IDENTIFICATION OF THE PARTIES

The first party CLAVE DENIA, S.A., hereinafter ALE-HOP, whose other identifying data are contained in the Legal Notice and owner of the domain WWW.ALE-HOP.ORG, hereinafter Website, and the second party; the User that contracts the products that are offered through the Website.

2.- ACCEPTANCE AND MODIFICATION

The User declares that they have the legal capacity to enter into this contract and accepts full and unreserved adherence to the General Contracting Conditions, hereinafter GCC, in the version published at the time of contracting.

3.- OBLIGATIONS OF THE PARTIES

ALE-HOP's Obligations:

  • -To provide the services in accordance with the GCC and without breach of contractual good faith.

  • -To make the GCC available to the User and the particular conditions where appropriate.

  • -To send the User proof or an invoice of the contracted products

Obligations of the User:

- To carry out full compliance with the provisions of the GCC.

- To complete the registration forms with truthful and current information. The User will be solely responsible for the veracity of the information and for keeping it up-to-date.

- To maintain the confidentiality of the information provided and immediately provide notification of its loss, misplacement, theft, or illegitimate access, as well as knowledge of it by third parties.

- To act diligently, at all times following good practices and contractual good faith throughout the contractual relationship.

4.- PRE-CONTRACTUAL AND CONTRACTUAL IMPROVEMENT.

Placing the order

The purchase procedure that must be followed for online purchasing is as follows:

- Choose the product and/or products on the website

- Add the products to the cart.

- Select the shipping area to determine the corresponding postage.

- Click on start order.

- For your first order, registration data will be requested. If you are already registered, you can enter your user name and password to access your user area.

- Fill out the contact and shipping details.

- Accept the terms and conditions to access the payment.

- Include the payment details.

Once the payment details are properly validated, you will receive a confirmation e-mail to the e-mail address provided that serves as acknowledgement of receipt of the order.

Review your purchase before making the payment to have the possibility of making modifications to the order and/or contact and shipping details. Once payment has been made, no modifications can be made.

5.- AVAILABILITY OF PRODUCTS.

All orders are subject to the availability of the products. In case of temporary product unavailability, the User will be informed of this event and the new approximate delivery time via e-mail. In the event that the product is ultimately unavailable, you will be informed of such an event by e-mail, you may receive a product with similar characteristics or cancel the order.


If there is any stock breakage or any difficulty regarding the supply of products, we will inform you of this and refund the amount you have paid within a maximum period of 14 business days.

6.- PRICES

The prices published on the website include the corresponding VAT. The User will receive the total of these costs at the time of contracting the product. They do not include shipping costs, which will be added to the basket according to the shipping information provided and the total amount of the purchase.

ALE-HOP reserves the right to modify the prices published on the Website as it deems appropriate

7.- PAYMENT METHODS.

The payment methods accepted are as follows:

  • Credit card (Mastercard, Maestro, Visa)

If your bank account is in another currency, the exchange rate used for payment will be automatically calculated by your bank and will not under any circumstances be determined by ALE-HOP. By clicking on the "pay" button, you are confirming that you are the legitimate holder of the credit card and that the data included is not fraudulent.

To minimize the risk of unauthorized access, your credit card details will be encrypted. Credit cards will be subject to checks and authorizations by their issuing entity, but if that entity does not authorize the payment, we will not be responsible for any delay or lack of delivery, and the contract will not be formalized.

8.- TRANSMISSION OF RISK AND OWNERSHIP.

The User acquires ownership of the products at the time of full payment of all amounts, including shipping costs.

The risk of loss or deterioration will be passed on to the User when they or a third party indicated by them, other than the carrier, has acquired material possession. In case the User orders transport or the chosen carrier is not among those offered by ALE-HOP, the risk will be passed on to the User upon delivery of the goods to the carrier.

9.- SHIPPING AND DELIVERY POLICY.

Shipping areas

The shipping areas are: Spain, France, Italy, Germany, the Netherlands, Belgium, Luxembourg, and Austria. Although most islands of these countries are not included, we do ship to the Balearic Islands in Spain and Sicily in Italy.

Shipping costs

To place your order, you must purchase at least €10 of products.

The shipping costs will depend on the area to which the order is sent:

  • Standard shipping costs are €3,90 for the mainland territory and €7 for the Balearic Islands. However, if your order reaches or exceeds €40, standard shipping is free.

  • The shipping costs are 12€ for the other countries we ship to. However, if your products total €60 or more, shipping is free.

Shipping time

The shipping time will also depend on the area chosen for shipping:

  • For orders with shipping to the Spanish Peninsula and the Balearic Islands, the delivery time will be 2-3 working days from the time the order is placed. On designated dates (such as Christmas), orders may be delayed 5 to 8 working days.

  • For orders with shipping to other areas, the delivery time will be 4-6 working days from the moment the order is placed. On designated dates (such as Christmas), orders may be delayed 7 to 14 working days.

Free shipping

Starting at €40 totals, free shipping to Spain (peninsula) and the Balearic Islands. With an order of €40 or more, the shipping costs are free for the peninsular territory and the Balearic Islands.

With an order of €60 or more, the shipping costs are free to the European countries we deliver to.

With an order of €60 or more, the shipping costs are free to Italy, France, Germany, the Netherlands, Belgium, Luxembourg, and Austria.

Delivery

Before placing the order, you must select the delivery area where you want to receive it. All orders will be delivered to the address specified at the time of placing the order.

We will send you the order with the products listed in the order confirmation without undue delay and at the latest within 30 calendar days from the date of order confirmation.

Impossibility of delivery

If it is impossible for us to deliver your order due to absence at the given location, you must contact the carrier to set a new delivery date as soon as possible. If a new delivery date is not kept after the delivery attempts, the transport agency will keep it at its facilities pending pick-up. If the order is not picked up after 10 days, your order will be returned to our warehouse.

For an order not delivered for a reason not attributable to us, we will understand this to mean that you want to withdraw from the contract, and we will consider it resolved. As a result of the termination of the contract, we will refund all payments received, with the exception of shipping costs, within a maximum period of 14 days from the date on which we deem the contract terminated.

In case we are unable to meet the delivery deadlines of the order, you will be informed about the situation, and you will be given the option to continue with the purchase and set a new delivery date or cancel the order and receive a full refund of the amount paid.

10.- PROCEDURE, CANCELLATION AND WITHDRAWAL RIGHTS, AND LEGAL WARRANTY.

Procedure

To exercise the rights of cancellation, withdrawal, and use of the warranty, the User will need to contact ALE-HOP at 966 47 70 41 or info@ale-hop.net

Right of Cancellation

The User may cancel their order at no cost provided that this is communicated before the order has been made available to the carrier.

Right of Withdrawal

If you wish to withdraw from the contract, you may do so freely without giving any reason and without any penalty within 14 calendar days of material possession of the goods by you or a third party authorised by you, other than the carrier.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of an unequivocal declaration of withdrawal from the contract via the following contacts:

For this purpose, it is possible to use the withdrawal form available in APPENDIX I of this document, although its use is not mandatory

In case of withdrawal, we will refund all the payments you have made to us with the exception of the return costs when they cannot be returned normally by mail.

You will only be responsible for the decrease in the value of the goods resulting from manipulation of them other than that necessary to establish their nature, characteristics, or operation.

Personalized items, music CDs/DVDs without their original packaging, or goods sealed for health and hygiene reasons that have been unsealed will not be subject to withdrawal.

The right of withdrawal will be applicable as long as the products covered by this contract are returned in the same conditions (along with their complete original packaging, labels, and any accessories related to them), and the purchase invoice is included. In any case, ALE-HOP will determine whether these requirements are met.

Legal Warranty

The User has a three-year warranty period from the delivery of the product. This warranty does not include deficiencies caused by negligence, blows, use, or improper manipulations by the User. Unless proven otherwise, it will be presumed that any lack of conformity that manifests in the six months after delivery of the product already existed when the item was delivered.

The legal warranty includes the following rights for the User:

- If the product is not in conformity with the contract, the User will be able to choose between repair or replacement of the product unless one of these two options is objectively impossible or disproportionate to the detriment of ALE-HOP. All expenses for exercising this right will be free for the User.

- A price reduction and termination of the contract will take place at the User's discretion when the User cannot request repair or replacement and in cases where these have not been carried out within a reasonable time or without major inconvenience to the User. This resolution will not take place when the lack of conformity is insignificant.

Exchange and return policy

You can return your order at any of our physical stores in Spanish territory except for shops in the Basque Country or through parcel delivery on request through your user area. The return costs are covered by the customer and will depend on the shipping area.

We will refund the amount of the returned products to the same payment method used for the purchase within 15 days from the date of receiving the product at our warehouse for returns by parcel or for returns at a physical store in cash at the time of receiving the product at any of our stores in the Spanish territory.

Product exchanges can only be made at our physical stores in the Spanish territory except for shops in the Basque Country and will be accepted within 30 calendar days from the date of order confirmation.

For any exchange or return, it is necessary to present the purchase invoice and for the item to be in the appropriate conditions without exceeding the use needed to establish its nature, characteristics, and operation, and have its original packaging and the accessories that came with it.

Free in-store returns/exchanges

Authorized Ale-Hop stores

Changes and returns of online orders can be made at any physical store in Spain except for shops in the Basque Country.

Provide a simplified invoice for the return.

To exchange or return an online purchase, it is necessary to keep the simplified invoice you will receive with your order. In case you don't have it, don't worry: you can download it at any time through your client area.

Return by parcel

You can only make returns through parcel delivery. If you would like to make an exchange, such as in size or color, you would have to return the item and place a new order with the items you want to receive.

Cost of return by parcel

Like shipping costs, the return cost will depend on where we pick up the product. The pick-up costs will be €5 for the peninsular territory, €7 for the Balearic Islands, and €12 for all other areas with shipping.

How to request a refund

In your customer area you will find a section for returns. To request it, follow the steps below: 

1 - Go to the "my returns" section at the bottom left.

2 - Click "create return."

3 - Select the order that contains the products you want to return.

4 - Select the products to be returned and the quantity (if you bought more than one).

5 - Select the reason for the return.

6 - Accept the terms and conditions and submit.

7 - The rest is up to us. We will contact you with updates about the status of the return.

Preparing your products for pick-up

Once we review your request and accept it, we will contact you to give you information about the pick-up with the transport agency. Once you have this information, we will need you to put the product in a small box that's a similar size to the product(s) being returned. The same box in which the order was received can be used. In addition, the simplified invoice that you received with the order must be included; otherwise, we would not be able to identify it.

Pick-up by the carrier

In the next few days after authorization, a carrier will stop by the address to pick up the package and add the label to send it to our warehouse.

Refund

Once we receive the package at our facilities, we will check to make sure the product is in perfect condition and then proceed with the refund. This refund will be made 3 to 10 days after receiving the product at our warehouse. We will refund it to the same payment method with which the purchase was made. Remember that the refund amount will be that of the product(s) minus the corresponding return costs.

Returns of defective products and complaints

If the purchased product does not comply with the stipulations of the contract, or you want to make a complaint, you must contact us as soon as possible through our contact form, by e-mail at info@ale-hop.net or at the phone number 96 64 77 623.

The product can be returned or exchanged at any of our stores in the Spanish territory or through free home pick-up, requested through our contact form, user area, or by e-mail or phone. In the latter case, we will request visual documentation where the defect of the article is clearly verifiable. If the item does have some defect, you can choose a refund of the amount or replacement of the item. The refund or replacement will be made as soon as possible, within at most 14 days from the date of confirmation of the refund or replacement.

A product whose defect is due to non-compliance with the instructions or misuse will not be refunded or exchanged.

11.- INDUSTRIAL AND INTELLECTUAL PROPERTY.

All copyright, trademark, and other intellectual property rights on the materials or contents that are part of the website are owned by Ale-Hop; thus, this material may only be used in the manner expressly authorized. This material and content may only be used in the manner expressly authorized by us. This does not prevent you from using the website to copy contract details or information about your order.

12.- LINKS AND COMMUNICATIONS.

Links displayed on the website

The links that redirect to other websites or third-party materials are provided for the sole purpose of providing information; we do not have any control over the content of these websites or materials. Therefore, no liability can be attributed to us for any damage or harm arising from their use.

Communications with customers

The applicable legislation requires that information or communications be sent in writing. By using this website, you agree that communications with us will be electronic. For contractual purposes, you agree to use this means of electronic communication and acknowledge that all contracts, information, and other notifications sent electronically comply with the legal requirement to be made in writing. This condition will not affect the rights recognized by law.

13.- NOTIFICATIONS.

ALE-HOP designates the location provided in the Legal Notice as its domicile for the purposes of notifications. The e-mail provided by the User during the registration process will be the one used by ALE-HOP for the purposes of sending notifications. All notifications made in accordance with the indicated procedure will be considered validly made.

14.- COMPETENT JURISDICTION.

Force majeure events

We will not be held responsible for non-fulfillment of our obligations when these are due to reasons of force majeure. Force majeure means any unforeseen event or overpowering force that is beyond our control.

- General strike, lockouts, or other forms of protest;

- State of alert, emergency, or martial law;Disturbances of public order, riots, invasions, terrorist attacks or threats, wars, threats, or preparations for war;

- Fire, explosion, storm, flood, earthquake, collapse, epidemic, or any other natural disaster;Inability to use trains, ships, airplanes, motor transport, or other means of transportation, whether public or private;

- Inability to use telecommunications systems, whether public or private;

- Restrictions by any government or public authority in the form of acts, decisions, decrees, laws, regulations, or rules of any kind.

The obligations will be suspended during the period in which the reasons for force majeure are in effect, and we will extend the deadline to fulfill the obligations of a time equal to the duration of the cause of force majeure.

We will use reasonable means to end any force majeure events or to fulfill the obligations outlined in the contract, despite any force majeure events.

Applicable law and jurisdiction

All aspects related to the use of our website, as well as the application of these terms and conditions or any dispute related to their interpretation, validity, or breach of the contract will be subject to the competent Spanish courts. This will apply if there is no express waiver of the application of Spanish law.

Right to modify these conditions

We reserve the right to modify these terms and conditions at any time. The conditions of use for this website will be subject to the latest version of the terms and conditions, which will never be applied retroactively.

To place an order, you must accept the modifications, so we recommend not using the website if you do not agree with them.

Dispute resolution

In the event that you are dissatisfied with the acquisition of our items or with the service we provide, you may request an out-of-court resolution of a complaint and compensation for the contract made through electronic means available on the European Union's online dispute resolution platform
